A preliminary hearing has been set for Sept. 9 for Pedro Gutierrez Archuleta, 22, accused of fatally stabbing 16-year-old Jovita Becerra over 47 times in her Brawley apartment.

The date was set during an arraignment Thursday in the county jail court.

Also, Imperial County Deputy District Attorney Deborah Owen said the DA's office will decide whether to seek the death penalty against Archuleta after the preliminary hearing.

Jovita was killed May 7 in an apartment she shared with her mother. Brawley police officials, in earlier reports, said evidence and witness reports from the scene led them to Archuleta, who is the live-in boyfriend of one of Jovita's older sisters.

Archuleta and Jovita's older sister have children together.

Police also said Jovita was dropped off at the apartment in the late afternoon of May 6. She apparently was home alone when the murder occurred.
